App Development Terms & Conditions

These terms apply to Empex Digital app development services, including Validation MVP, Growth App, and Custom Product builds, unless otherwise agreed in writing.

Public app package prices are starting points. Final pricing depends on scope, product complexity, and integrations.

Important limitations

Timelines, integrations, app-store processes, and legacy systems can affect delivery time, scope, and final cost.

1. Overview

These Terms & Conditions govern the provision of app development services by Empex Digital.

By purchasing, accepting, or using an app development service from Empex Digital, the client agrees to these terms unless a separate written agreement has been signed by both parties.

App development services may include strategy, UX planning, interface design, backend development, integrations, testing, deployment preparation, and related technical work depending on the agreed scope.

2. Pricing guidance

Public prices shown on the website are guide prices and starting points only.

Final pricing depends on factors including platform choice, feature complexity, backend logic, user roles, dashboards, integrations, notifications, automation requirements, data structure, compliance requirements, and launch scope.

Empex Digital reserves the right to issue a tailored quote where the project falls outside the assumptions of the published package ranges.

3. Scope of service

App development services are limited to the agreed written scope for the project.

Depending on the project, services may include:

product planning and user flow definition
web app or mobile app interface build
authentication and user account logic
backend and database implementation
admin or dashboard functionality
API and system integrations
testing and launch preparation
deployment support

Services do not automatically include unlimited feature expansion, unrestricted design changes, large-scale product strategy work, unlimited QA cycles, app-store account management, ongoing maintenance, or unrestricted engineering time unless expressly agreed in writing.

4. Platforms and technology choices

Empex Digital may recommend a web app, cross-platform mobile app, cloud-backed platform, or another suitable technical route depending on goals, budget, timeline, and business requirements.

The final stack, hosting approach, data model, and deployment route may affect pricing, delivery time, and scope.

5. Integrations and third-party services

Apps may depend on third-party services such as payment gateways, maps, messaging providers, authentication providers, CRMs, analytics tools, AI services, cloud providers, or app store platforms.

Unless expressly stated in writing, third-party subscription fees, API usage charges, premium services, app store fees, hosting fees, and external tooling charges are not included in project pricing.

Empex Digital is not responsible for outages, pricing changes, API changes, approval decisions, policy changes, or service limitations caused by third-party providers.

6. Client content, data, and access

The client is responsible for providing accurate project information, business rules, required content, account access, and technical access needed to complete the agreed work.

Delays caused by incomplete specifications, missing assets, delayed approvals, missing credentials, or late client feedback may affect the timeline and delivery schedule.

7. Revisions and approvals

Reasonable revisions may be included according to the agreed project scope, but substantial changes to approved direction, new feature requests, platform changes, or major scope expansion may require a revised quote.

Work may progress in stages, and approval at one stage may be treated as acceptance of that stage for project progression.

8. Launch and post-launch support

Empex Digital may provide launch support as part of the agreed scope.

Ongoing maintenance, app updates, new features, store submission support beyond agreed scope, operational monitoring, and continued technical care are not assumed to be included unless a separate support arrangement is in place.

Where app-store publication is relevant, approval is ultimately controlled by the relevant platform provider and cannot be guaranteed by Empex Digital.

9. Payment terms

Project payment terms will be stated in the quote, invoice, or written agreement.

Unless otherwise agreed, work may be scheduled only after an initial payment has been received.

All stated prices are exclusive of VAT unless expressly stated otherwise.

Additional work outside agreed scope will be quoted separately and will not begin until approved.

10. Cancellation and pause

If the client cancels a project after work has begun, Empex Digital reserves the right to invoice for work already completed, time already allocated, non-refundable third-party costs already incurred, and any project phase that has substantially commenced.

Where a project is paused for an extended period due to client delay, Empex Digital may reschedule delivery and may issue an updated quote if the project requirements, timeline, or external costs have materially changed.

11. Liability and limitations

Empex Digital will provide services with reasonable care and skill.

However, Empex Digital is not liable for indirect loss, loss of profit, loss of revenue, loss of opportunity, loss of reputation, or consequential loss arising from project delay, third-party service issues, app-store decisions, or issues outside reasonable control.

Empex Digital is not responsible for failures or restrictions caused by third-party APIs, hosting failures, cloud provider limitations, app-store rejection, inaccurate client-supplied data, or undocumented legacy systems.

12. General terms

These terms may be updated from time to time. The latest version published by Empex Digital will apply to future projects unless a separate written agreement states otherwise.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

These terms are governed by the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the courts of England and Wales.
